ПРІОРИТЕТНІ НАПРЯМИ РОЗВИТКУ ПРОДУКТИВНИХ СИЛ СЕЛА В КОНТЕКСТІ ТЕРИТОРІАЛЬНОЇ ДЕЦЕНТРАЛІЗАЦІЇ

Анотація

Стаття присвячена питанням розвитку продуктивних сил регіонів в умовах територіальної децентралізації. Автори на основі Закону «Про добровільне об’єднання територіальних громад», «Про місцеве самоврядування в Україні» аналізують процес створення об’єднаних територіальних громад. Окремо розглянуто термін «спроможні територіальні громади», суть якого конкретно викладено в Методиці формування спроможних територіальних громад, яку Кабінет Міністрів України затвердив 8 квітня 2015 р. постановою № 214.

Зокрема, в статті розглянуті питання фінансування територіальної громади, формування дохідної частини її бюджету, оподаткування, активізації діяльності споживчої кооперації.

Для забезпечення спроможності об’єднаних територіальних громад уже найближчим часом необхідно відновлювати економічний потенціал населених пунктів, насамперед підприємств переробки сільськогосподарської сировини.

Розвиток продуктивних сил регіонів сприятиме реанімації діяльності на селі споживчої кооперації, будівництво заводів по переробці ріпаку, сої, соняшнику, що допоможе у створенні нових робочих місць та відновленні економічного потенціалу регіонів.

Studying the legal basis of self-employment in Ukraine is carried out by analyzing the relevant legislation. The article deals with the current issues and trends in the employment. The employment service is analyzed and legislative acts on employment and the labor market are explored. It is proposed the ways of improving the efficiency of labor potential. The need for legal reform on self-employment is motivated. The suggestions for improving the legal documents on regulation of self-employment of the population, in order to increase its efficiency and enhance competitiveness in the labor market are given.

In the context of strengthening the legal security of self-employment it is proposed to adopt a Law ”On self-employment of population ”. All rights and responsibilities of self-employed are sure to be written. The author of the article offers to form a professional association of self-employed, which would performed as a defender of their interests and proposes to make the appropriate amendments to the laws ”On Employment of Population”, ”On Pension System”, ”On labor in Ukraine”, ”On Labor Protection”, ”On Collective Bargaining and agreements ”.

The author believes that improving the ”Tax Code” it is necessary to prescribe in detail the features of self-taxation, which should serve as the basis for the "legalization” of employment.

The laws on the legal provision of social protection of self-employed are of a great importance. It is proposed to make some appropriate amendments to the Law ”On Compulsory State Insurance”, ”On state social standards and state social guarantees”.

The proposed by the author recommendations will help to reduce the amount of unemployment, the ratio of employees in the ''shadow ” economy.
